These Terms of Service apply to your use of this website and to every order placed with VAPICOS US. By browsing the site or placing an order you agree to them. Please read them together with our Shipping, Return, Privacy and Age Verification policies.

Age and eligibility

Our products contain nicotine and are intended only for adults aged 21 or older. To use this site, create an account or buy from us you must:

• be at least 21 years old (federal minimum age for tobacco and nicotine products, or older if your state or locality sets a higher age);
• be an existing user of nicotine or tobacco products;
• provide accurate personal, billing and delivery information that matches your identity; and
• buy for your own personal use, not for resale or for anyone under the legal age.

We verify the age of every buyer before dispatch, and an adult signature with ID may be required at delivery. Details are in our Age Verification Policy. Providing false information, or attempting to buy for a minor, will result in order cancellation and account closure, and may be reported to the authorities.

Local laws and restricted areas

Vapor products are regulated by federal, state and local laws, including the federal PACT Act and state or city bans on online sales, flavored products or certain nicotine strengths. You are responsible for making sure that you may legally buy, receive and possess the products you order at your delivery address. We do not knowingly ship to areas where delivery is prohibited and may cancel and refund any order to a restricted address.

Products and health warnings

WARNING: These products contain nicotine. Nicotine is an addictive chemical. They are not smoking-cessation products and are not intended to diagnose, treat or prevent any disease. Do not use if you are pregnant or breastfeeding, have a heart condition or high blood pressure, or are sensitive to nicotine; consult a doctor if you have any health concerns. Keep all products out of reach of children and pets.

• Puff counts, battery life and e-liquid volumes are manufacturer estimates; real results vary with how you vape and the mode used.
• Product images are illustrative. Packaging and device colors may change between production batches.
• Replacement pods must be used with their matching device or power bank.
• Charge devices only with a suitable USB-C cable, never leave them charging unattended, and dispose of used devices and batteries according to local e-waste rules — do not put them in household trash or recycling bins where this is prohibited.

Prices, taxes and pricing errors

Prices are in US dollars (USD) and may change without notice. Shipping and any applicable sales or excise taxes are calculated and shown at checkout before you pay.

We work hard to show accurate prices and product information, but errors can occur. If a product is listed at an obviously incorrect price or with incorrect information, we may cancel the order (even after confirmation) and refund you in full, or contact you to ask whether you wish to continue at the correct price.

Orders and acceptance

Your order is an offer to buy. You will receive an order confirmation email, but a binding contract is formed only when we ship your order. We may refuse, limit or cancel any order, including orders that:

• fail age or identity verification;
• are addressed to an area where the products cannot legally be delivered;
• appear fraudulent, or exceed reasonable personal-use quantities or any legal purchase limit;
• contain a pricing or listing error, or include items that are out of stock.

If we cancel an order for any of these reasons, any amount paid is refunded to your original payment method. Pack sets ship in randomly assorted flavors from available stock. You may list preferred flavors in the order notes at checkout; we pack them when in stock and assort any others at random.

Payment

Payment is taken when you place your order and is processed by third-party payment providers. You confirm that you are authorized to use the payment method provided. See Payment Methods for details. Chargebacks filed for orders that were delivered as described may be disputed with supporting delivery and signature evidence.

Accounts

You are responsible for keeping your login details confidential and for all activity under your account. We may suspend or close accounts that break these terms.

Shipping and returns

Delivery times, adult-signature delivery and restricted areas are covered in our Shipping Policy. Defective-item claims, returns and refunds are covered in our Return Policy. Risk of loss passes to you on delivery.

Use of the website

You agree not to use the site for any unlawful purpose, interfere with its security or operation, scrape or access it by automated means, or post false or harmful content. All text, graphics, logos and images on this site are owned by us or our licensors and may not be copied or reused without permission. Brand names and trademarks belong to their respective owners and are used only to identify the products we sell.

Disclaimer of warranties

Except as stated in our Return Policy, and to the fullest extent permitted by law, the website and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Any manufacturer warranty is provided by the manufacturer, not by us.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site or the products, including damage caused by misuse, improper charging or use contrary to the manufacturer’s instructions. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Some states do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold us harmless from any claims, losses or costs (including reasonable attorneys’ fees) arising from your breach of these terms, your misuse of the products, or any false information you provide, including about your age.

Governing law and disputes

These terms are governed by the laws of the State of Texas and applicable US federal law, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to their jurisdiction. Before starting any formal claim, please contact us so we can try to resolve the issue first.

Changes to these terms

We may update these terms at any time by posting a new version on this page. The version in force when you place an order applies to that order. If any provision is found unenforceable, the remaining provisions stay in effect.
